New export control items! Ministry of Commerce General Administration of Customs Announcement No. 33 of 2024

In accordance with the relevant provisions of the the People's Republic of China Export Control Law, the the People's Republic of China Foreign Trade Law, and the the People's Republic of China Customs Law, in order to safeguard national security and interests and fulfill international obligations such as non-proliferation, with the approval of the State Council, it is decided to implement export control on the following items. The relevant matters are hereby announced as follows:
1. items meeting the following characteristics shall not be exported without permission:
(I) antimony-related items.1. Antimony ores and raw materials, including but not limited to bulk, granular, powder, crystalline and other forms. (Refer to customs commodity numbers: 2617101000, 2617109001, 2617109090, 2830902000)2. Metal antimony and its products, including but not limited to ingots, blocks, beads, granules, powders and other forms. (Refer to customs commodity numbers: 8110101000, 8110102000, 8110200000, 8110900000)3. Antimony oxide with a purity greater than or equal to 99.99, including but not limited to powder form. (Refer to customs commodity number: 2825800010)4. Trimethyl antimony, triethyl antimony and other organic antimony compounds, purity (inorganic element basis) greater than 99.999. (Reference Customs Article Number: 2931900032)5. Antimony hydride, purity greater than 99.999 percent (containing antimony hydride diluted in inert gas or hydrogen). (Reference customs commodity number: 2850009020)6. Indium antimonide, with all the following characteristics: single crystal with dislocation density less than 50/cm2, and polycrystalline with purity greater than 99.99999, including but not limited to ingots (rods), blocks, tablets, targets, particles, powder, crushed materials and other forms. (reference customs commodity number: 2853909031)7. gold antimony smelting separation technology.
(II) superhard material related items.
1.Six-sided top press equipment, with all the following characteristics: specially designed or manufacturedX/Y/ZThree-axis six-sided synchronous pressurized large hydraulic press, cylinder diameter size greater than or equal500mm or design use pressure greater than or equal5Gigapascals. 2.Special key parts for six-sided jacking press, including hinge beam, jacking hammer, composite pressure greater5Gigapascal high pressure control system. (Reference Customs Article No:8479909020,9032899094)
3.Microwave plasma chemical vapor deposition (MPCVD) Equipment, with all the following characteristics: specially designed or manufacturedMPCVDequipment, microwave power in10kW or more, and the microwave frequency is915Megahertz or2450Megahertz. (Reference Customs Article No:8479899957)
4.Diamond window material, including curved diamond window material, or flat diamond window material having all of the following characteristics: (1) Diameter3inch and above single crystal or polycrystalline; (2) Visible Light Transmittance65%and above. (Reference Customs Article No:7104911010)
5.Synthetic diamond single crystal or cubic boron nitride single crystal process technology with six-sided top press.
6. Technology of six-sided top press equipment for manufacturing listed tubes.
2. export operators shall go through the export licensing formalities in accordance with the relevant provisions, submit an application to the Ministry of Commerce through the provincial competent department of commerce, fill in the application form for the export of dual-use items and technologies and submit the following documents:
The original of the (I) export contract or agreement or a copy or scanned copy consistent with the original;
(II) technical descriptions or test reports of the items to be exported;
(III) end-user and end-use certificates;
Presentation of (IV) importers and end-users;
(V) the identity certificates of the applicant's legal representative, principal business manager and manager.

The Ministry of Commerce of the 3. shall, from the date of receipt of the export application documents, or jointly with the relevant departments, conduct the examination, and make a decision on granting or disapproving the license within the statutory time limit. The export of items listed in this announcement that have a significant impact on national security shall be submitted by the Ministry of Commerce in conjunction with relevant departments to the State Council for approval.
If the 4. approves the license after examination, the Ministry of Commerce shall issue the export license for dual-use items and technologies (hereinafter referred to as the export license).
The procedures for the application and issuance of 5. export licenses, the handling of special circumstances, and the number of years of preservation of documents and materials shall be in accordance with the orders of the Ministry of Commerce and the General Administration of Customs.2005Year No.29(Measures for the Administration of Import and Export Licenses for Dual-Use Items and Technologies).
6. export business operators shall issue export licenses to the customs, go through customs formalities in accordance with the provisions of the the People's Republic of China Customs Law, and accept customs supervision.Customs shall go through the formalities of inspection and release on the basis of the export license issued by the Ministry of Commerce.
If an 7. exporter exports without permission, exports beyond the scope of permission or has other illegal circumstances, the Ministry of Commerce or the Customs shall impose administrative penalties in accordance with the provisions of relevant laws and regulations. If a crime is constituted, criminal responsibility shall be investigated according to law.
